Terms of Service

These Terms of Service ("Terms") govern your access to and use of Emaissary (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. Emaissary ("we", "us") is operated by its founder.
1. The Service
Emaissary is an AI outreach copilot. Our agents research your market, identify accounts worth contacting, and draft personalized outreach on your behalf. A human approves every send — the Service does not send messages autonomously. You review each draft in your queue and decide whether it goes out, gets edited, or is discarded.
2. Account Registration
To use the Service you must create an account with a valid email address, or sign in through a supported identity provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at hello@emaissary.com if you suspect unauthorized use.
3. Subscriptions & Billing
Emaissary offers a free trial followed by paid subscription plans. Paid subscriptions are billed on a recurring basis through our merchant of record, Lemon Squeezy, who handles payment processing, tax collection, and remittance for these transactions. Prices and trial terms are shown at checkout before you are charged.
- By subscribing, you authorize recurring charges to your selected payment method.
- Subscriptions renew automatically unless cancelled before the next billing cycle.
- You may cancel at any time; cancellation takes effect at the end of the current paid period.
4. Refunds
The free trial is intended as your evaluation period before you commit to a paid plan. Refund eligibility, the request process, and processing timelines are described in full in our Refund Policy.
5. Acceptable Use
You agree to use the Service only for lawful outreach and in accordance with our Acceptable Use Policy, which prohibits unsolicited bulk email, purchased, rented, or scraped recipient lists, deceptive sender information, and similar abuse. We may suspend or terminate accounts that violate this policy.
6. Your Content & Data
You own the prospect data you add to Emaissary, whether entered manually, imported by CSV, or synced through a connected integration. You grant us a limited license to store, process, and analyze this data solely to provide the Service to you — for example, to research accounts, draft messages, and track outreach performance. We will not sell your data or use it to train models for other customers.
7. Outreach Responsibility
You are the sender-of-record for every message you approve or send through Emaissary. You are responsible for ensuring your outreach complies with applicable email and anti-spam laws (such as CAN-SPAM, GDPR, and ePrivacy rules that apply to you), for maintaining a lawful basis to contact your prospects, and for honoring opt-out and unsubscribe requests promptly. Emaissary provides drafting tools and safeguards, but the decision to send — and the legal responsibility for having sent — rests with you.
8. Service Availability
We aim to keep the Service available and performant but provide it on an "as available" basis without an uptime guarantee or formal service-level agreement. Scheduled maintenance, third-party outages, or events outside our control may temporarily affect access. We are not liable for losses resulting from such downtime.
9. Termination
Either party may terminate this agreement at any time — you by cancelling your subscription or deleting your account, and we by suspending or terminating accounts that violate these Terms or applicable law. What happens to your data after termination is described in our Privacy Policy.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service, or any content it generates, will be error-free or meet your specific requirements.
11. Limitation of Liability
To the maximum extent permitted by law, Emaissary and its founder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim relating to the Service is capped at the fees you paid in the twelve (12) months preceding the claim.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of your jurisdiction of use, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through good-faith negotiation first, and through binding arbitration if negotiation fails.
